These Terms and Conditions set out the basis on which Rubbish Removal Kentish Town provides rubbish removal, clearance and related waste collection services. By placing a booking or instructing us to carry out any work, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, landlord, property manager or organisation booking or receiving our services.

Services means any rubbish removal, waste collection, clearance, loading, transportation, recycling, disposal, or associated services carried out by us.

Waste means the items, materials, goods or substances that the Customer asks us to remove, collect, transport or dispose of.

Booking means a confirmed request by the Customer for the provision of Services at a specified time, date and location.

We, us and our mean the provider trading as Rubbish Removal Kentish Town.

2. Scope of Services

We provide rubbish removal and waste collection services for domestic and commercial customers within our usual service area, which includes Kentish Town and surrounding locations. The precise scope of Services to be provided in each case will be agreed at the time of booking or on arrival at the premises, subject to these Terms and Conditions.

Our Services typically include the loading of Waste from the Customer's premises, transport of such Waste, and delivery of that Waste to an authorised waste transfer station or facility for treatment, recycling or disposal in accordance with applicable legislation.

We reserve the right to refuse to collect any items that, in our reasonable opinion, are hazardous, prohibited, unsafe to handle or transport, or not in compliance with waste regulations or these Terms and Conditions.

3. Booking Process

Bookings may be made by telephone, email or other communication channels we make available. The Customer must provide accurate details including the collection address, type and approximate volume of Waste, access arrangements, preferred dates and contact information.

Any quotation provided prior to arrival is based on the information supplied by the Customer. If the Waste is materially different in type, volume, weight or location from that described, we may revise the quotation, adjust the price or decline to carry out the Services.

A Booking is considered confirmed when we have accepted the Customer's request and provided confirmation of the scheduled collection time and any applicable charges. We may, at our discretion, require a deposit or pre-authorised payment to secure the Booking.

We will make reasonable efforts to attend at the agreed time, but timings are estimates only and are subject to traffic, operational and weather conditions. We will not be liable for any loss arising from early or late arrival, provided we attend on the booked date or as otherwise agreed.

4. Access and Customer Responsibilities

The Customer is responsible for ensuring safe, reasonable and lawful access to the premises and to the Waste to be removed. This includes arranging necessary parking or permits, ensuring that entrances, stairways, lifts and pathways are clear, and that there are no health and safety hazards that might endanger our staff or equipment.

The Customer must be present, or ensure that an authorised representative is present, at the agreed time to give instructions, confirm the Waste to be removed and approve any changes to the quotation. If no one is present when we attend, we may at our discretion attempt to contact the Customer, but we reserve the right to treat the Booking as cancelled and to charge a call-out or cancellation fee.

The Customer warrants that they are either the owner of the Waste or have full authority from the owner to arrange for its removal and disposal. The Customer shall indemnify us against any claim by a third party alleging that the removal of Waste was unauthorised.

5. Pricing and Quotations

Our charges are based on factors including the volume, type and weight of Waste, the time required to complete the job, access conditions, and any additional labour or services requested. We may use standard price bands or provide bespoke quotations, which will be explained to the Customer before work begins.

All quotations are given in good faith based on the information available at the time. Quotations are not binding if the actual Waste or working conditions differ materially from what was described or reasonably expected. In such cases we will advise the Customer of any revised price before continuing, and the Customer may either accept the new price or decline further work.

Unless otherwise stated, prices are exclusive of any applicable taxes or government charges. If value added tax is chargeable on the Services, it will be added at the prevailing rate and clearly stated on the invoice.

6. Payments

Payment terms will be agreed at the time of booking. Unless we have agreed credit terms in writing, payment is due in full on completion of the Services and prior to our vehicle leaving the site.

We accept the payment methods that we specify from time to time, which may include cash, card payments or bank transfer. We may require card details to secure the Booking and we may pre-authorise an amount on the Customer's card in advance of the collection.

Where credit terms are agreed, invoices are payable within the period stated on the invoice. If payment is not received by the due date, we reserve the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs incurred in pursuing payment.

We may suspend or refuse further Services to any Customer whose account is overdue or who has previously failed to make payment when due.

7. Cancellations and Amendments

The Customer may cancel or amend a Booking by giving us reasonable notice before the scheduled collection time. We request at least 24 hours notice for cancellations or significant changes to avoid charges.

If the Customer cancels with less than 24 hours notice, or fails to provide access at the agreed time, we reserve the right to charge a cancellation or call-out fee to cover our costs and lost time.

Where a deposit or pre-payment has been taken, we will apply our refund policy as communicated at the time of booking. Certain deposits may be non-refundable if the Booking is cancelled late without good cause.

We reserve the right to cancel or reschedule a Booking if we are unable to attend due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, accidents, or staff illness. In such cases we will attempt to offer an alternative slot as soon as reasonably possible. We will not be liable for any indirect loss arising from such cancellation or rescheduling.

8. Waste Regulations and Environmental Compliance

We operate in accordance with applicable waste and environmental legislation and regulations in England and Wales. Waste collected by us will be transported and transferred only to authorised facilities and operators.

The Customer is responsible for declaring any hazardous, clinical or special Waste, including but not limited to chemicals, solvents, asbestos, oils, paints, gas bottles, tyres, batteries or electrical equipment that may require special handling. We may refuse to remove or handle such items unless we have specifically agreed to do so and have the appropriate licences and arrangements in place.

The Customer must not include in general mixed Waste any materials that are prohibited from disposal through normal waste streams. If such items are discovered within the Waste after collection, the Customer may be liable for additional charges and for any fines or costs incurred as a result of non-compliance with waste regulations.

We may separate, reuse or recycle Waste where possible in order to minimise landfill and comply with environmental obligations. Once Waste has been removed from the premises and loaded onto our vehicle, ownership of that Waste passes to us, and we may handle it in accordance with applicable law.

9. Liability and Limitations

We will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that some risk of minor damage is inherent in the handling and removal of bulky or heavy items, particularly in confined spaces or areas with restricted access.

We will not be liable for any damage to property, fixtures or fittings that arises from pre-existing defects, inherent weaknesses, poor construction, or where we have followed the Customer's specific instructions despite having advised of potential risks.

Our total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort including negligence or otherwise, shall not exceed the total price paid or payable by the Customer for the relevant Services, except in cases of death or personal injury caused by our negligence, fraud, or any other liability that cannot legally be limited.

We will not be liable for any indirect or consequential loss, including loss of profit, business interruption, loss of data, or loss of opportunity, arising from or in connection with the Services or these Terms and Conditions.

10. Customer Property and Valuables

The Customer is responsible for ensuring that no items of value, personal belongings or important documents are included in the Waste to be removed. Once items are loaded and removed, they cannot be retrieved.

We accept no responsibility for any loss of or damage to items that the Customer or their representatives have mistakenly included in the Waste. The Customer should carefully check all items and areas before we commence loading.

11. Health and Safety

We take health and safety seriously and our staff are required to follow safe working practices. The Customer agrees not to request or insist on any action that may put our staff at risk, such as overloading vehicles, carrying excessively heavy items without proper equipment, or working in unsafe conditions.

If we consider that a situation presents an unacceptable risk to our staff, the public or property, we may suspend or refuse to continue the Services until appropriate measures are taken. The Customer may be liable for any wasted journey fees if safe access cannot be provided.

12. Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Services, they should notify us as soon as possible, ideally on the day of service or within a reasonable time thereafter. We will investigate any complaint promptly and seek to resolve it through discussion and, where appropriate, remedial action.

Any claim relating to alleged loss or damage must be reported to us in writing within a reasonable period and in any event no later than 14 days from the date of the Services. Failure to notify us within this period may prejudice our ability to investigate and may affect the outcome of any claim.

13. Data Protection and Privacy

We may collect and process personal information about the Customer, such as contact details and payment information, for the purposes of administering Bookings, providing the Services, processing payments, and handling any queries or complaints.

We will handle personal information in accordance with applicable data protection law and will not sell or disclose it to third parties except where necessary to provide the Services, comply with legal obligations, or with the Customer's consent.

14. Force Majeure

We shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, without limitation, extreme weather, strikes, industrial disputes, accidents, traffic incidents, road closures, acts of God, or government restrictions.

15. Variation

We may amend or update these Terms and Conditions from time to time. The version in force at the time of the Booking will apply to that Booking. A current copy of the Terms and Conditions will be made available on request.

16. Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted to the extent necessary, but the remaining provisions will continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, provided that nothing in this clause shall limit the right of either party to seek interim or injunctive relief in any appropriate jurisdiction.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of Booking, constitute the entire agreement between the Customer and us in relation to the Services. They supersede any prior understandings, agreements or representations, whether oral or written, relating to the subject matter of the Services.

By confirming a Booking or allowing our team to commence work, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
